Madeira Beach takes action on solicitors

MADEIRA BEACH – The City Commission took final action recently in approving an ordinance that will outlaw public solicitation in the city except from permanently enclosed structures.
The new law requires that any booths, kiosks, temporary structures, carts, canopies, tents, etc. in existence be removed by Feb. 28.
Although the ordinance covers the entire city, Commissioner Arnold Alloway said a major intent of the law is to clean up problems with kiosks and carts at John’s Pass Village, which he said had gotten out of hand.
A related ordinance setting fees for solicitors’ permits narrowly passed 3-2. The ordinance set a fee of $10 for businesses currently located in the city, good for 60 days, soaring to $100 for non-local firms. Commissioners Alloway, John Wolbert and Nancy Oakley voted for the fee schedule; Mayor Charles Parker and Commissioner Steve Kochick opposed it.
Kochick said following the meeting that he felt the fee differential for local vs. non-local businesses was “excessive.”
“I agree the (outside businesses) should pay more, but not that much,” he said.
Community Development Director Paula Cohen said the fee schedule helps support city businesses.
City Attorney Michael Connolly admitted the ordinance will be very difficult to enforce. Offenses are not treated as code infractions; violators must be taken to court, Connolly said.
