Biltmore demolition paperwork in

BELLEAIR – The attorney representing the owners of the Belleview Biltmore Resort and Spa has submitted demolition permit application information that previously had been deemed insufficient.

“We believe that this completes the development (demolition) permit application and responds to the various items identified in your November 15 correspondence as insufficiencies in the application,” writes Belleview Biltmore Resort, Ltd. attorney Roger D. Schwenke in a Nov. 23 letter to Town Manager Steve Cottrell.

Since May, the town has twice returned the permit application to Schwenke, citing various deficiencies that prevented it from moving to the review process.

In the letter to Cottrell, Schwenke takes issue with what he refers to as “incompleteness determinations.”

“We believe that the town’s reaction to these could easily be considered to be unreasonable, arbitrary and capricious,” said Schwenke.

Nonetheless, details have been provided to the town regarding the location of fire service lines and tree protection plans on the site, which had been deemed incomplete on Nov. 15.

The latest revisions are being reviewed by Cottrell, attorney Nancy Stroud and engineering consultants TBE Group.

“The next step would be to give it (permit application) to the commission and/or the Planning and Zoning Board for their review,” said Cottrell. “It will take weeks to go through the process.”

The commission could opt to also send the permit application to the town’s historic preservation board for its consideration. The town recently enacted an historic preservation ordinance which could prove problematic in any plan to demolish the historic Belleview Biltmore Resort and Spa.

The Town Commission meets next on Tuesday, Dec. 6.
